What is the process to claim shares after the death of the demat account holder if the nominee is not nominated?

If the account holder passes away and the nominee is not appointed, then there are two scenarios the successor has to consider.

a. If the total value of holding and funds is less than or equal to ₹ 5 lakhs.

If the total value of holding and funds is less than or equal to ₹ 5 lakhs, then the successor has to submit the following documents

  • Duly filled Transmission Request From (PDF).
  • Notarized copy of the death certificate.
  • Successor Identity Proof. (PAN/Aadhaar)
  • Successor holder/s cancelled cheque or bank account statement.
  • In case the Successor has the demat account in another broking house, then Client Master Report (CMR) copy with DP seal and signature.
  • Any one of the following documents:

    •Letter of Indemnity [pdf] executed by the applicant on a non-judicial stamp paper of ₹ 200 value and duly notarized.

    •An affidavit from the applicant drafted on non-judicial stamp paper of ₹ 100 value and duly notarized.

    •A copy of the family settlement deed, which is duly notarized or attested by Gazetted Officer and executed by all legal heirs of the deceased person.

b. If the total value of holding and funds is more than ₹ 5 lakhs.

If the total value of holdings and funds exceeds ₹ 5 lakhs, then the successor has to submit the following documents

  • Duly filled Transmission Request From (PDF).
  • Notarized copy of the death certificate.
  • Successor Identity Proof. (PAN/Aadhaar)
  • Successor holder/s cancelled cheque or bank account statement.
  • In case the Successor has the demat account in another broking house, then Client Master Report (CMR) copy with DP seal and signature.
  • Any one of the following documents:

    • A Succession Certificate.

    • A Letter of Administration.

    • A Probate of the will of the deceased (All of these can be obtained in the district court)
